Abstract:
Abstract: This paper concentrates on reformulation markers in judicial argumentation
and, more particularly, in a parallel corpus of French judgements issued by the Court
of Justice of the European Union (CJUE_Fr) and translated into Italian (CJUE_It) and
Romanian (CJUE_Roum). These are primarily directive and argumentative texts. To
the extent that reformulation markers have a strong explanatory power and can significantly
contribute to achieve clarity, we will be dealing with the occurrence and uses of
three major categories: (i) inclusion or membership markers, (ii) linking markers that
signal equivalences between definiendum and definiens within definitions, and (iii)
markers that introduce explanatory exemplification (Preite 2020: 24). Importantly,
qualitative data analysis shall enable us to investigate the translation strategies adopted
as a first step, and, second, to discuss and assess the impact that French procedural
language might have on Italian and Romanian procedural language.
