Corte dei conti e indirizzo politico costituzionale: un’ipotesi ricostruttiva

The contribution examines the possible involvement of the Court of Auditors in the exercise of the function of constitutional political direction. After reviewing Paolo Barile’s concept of ‘constitutional political direction’, it first demonstrates that neither the presumed designation of the Court of Auditors as a body of constitutional relevance nor its auxiliary role pose obstacles to its participation in this function. The core thesis is that, in any case, the Court is currently able to influence, but not to jointly determine, the function of constitutional political direction. To support this thesis, an analysis of the Court of Auditors’ constitutional position, as outlined in the Constitution, is accompanied by a review of recent and past institutional events considered particularly significant.
