The New Europan Legal Fremework to Manage Bank Crises

La direttiva BRRD (Bank Recovery and Resolution Directive) ha introdotto un nuovo sistema di gestione e risoluzione delle crisi degli istituti bancari. La novità principale è rappresentata dall’abbandono del meccanismo di risanamento pubblico delle banche (bail-out) alla conseguente introduzione di uno strumento interno (bail-in), che fa ricadere il peso del dissesto finanziario della banca direttamente sugli investitori ed i creditori per il suo salvataggio. Alla luce di tale nuovo assetto normativo, tale contributo si interroga sulla portata e capacità della Direttiva di far fronte a future crisi bancarie europee.

The BRR Directive (BRRD, “Bank Recovery and Resolution Directive”) has introduced a new crisis management resolution system for banking institutions. The main novelty of such a legal framework is the switch from the public reimbursement of an insolvent bank (bail-out) to the introduction of an internal instrument (bail-in). With this new recovery mechanism, the economic burden of the instability of banks falls directly on its shareholders and creditors for its rescue. In the light of this new system, this work focuses on the scope and the capability of the Directive to face future European banking crises.
