Neutrality in Air Warfare

The lack of a normative codification of the rules of neutrality in air warfare may be seen as one aspect of a more general crisis of the law of neutrality, which has so far prevented the restatement of the traditional rules in the light of modern technological and normative development. This paper treis to assess all the issues related to neutrality in air warfare, including, among others, classification and markings of neutral aircraft, respect for neutral airspace and duties of prevention, neutral intercourse with belligerent and duties of abstention and impartiality, belligerents reprisals to redress violations of neutrality, and belligerent activities in on or over a neutral State's exclusive economic zone or continental shelf
