abstract:
Articles 19 and 22 of d.l. n. 18/2020 entrusted to collective bargaining a crucial role for the purposes of accessing safety net provisions. This role consisted in regulating conditions, benefi-ciaries and procedures to access the relevant social security payments. The article analyses collective bargaining agreements defining social security provisions provided by the wage guarantee fund and a number of bilateral bodies. From the analysis of regional, sectoral and company collective bar-gaining agreements, considering critical issues of the context in which they were born, it emerged that collective bargaining has fast “reacted” to the referrals that law legislation made to it. Indeed, collective bargaining did not strictly limit to competences recognized by the legislator but also shown that it can deal with crises with own tools and understand needs and specialities of territories and companies. Beyond the difficulties due to pandemic, the analysis of collective bargaining agreements might be useful for developing strategies and defining regulations in the view of manag-ing future risks the production system will have to face.
