Semplificazioni in materia di informazioni in merito al rapporto di lavoro e di obblighi di pubblicazione del contratto collettivo (art. 26, comma 1, d.l. n. 48/2023)

The present paper is concerned with an initial analysis of the regulatory provision of Article 26(1) of Decree-Law No. 48 of 2023, converted into law n. 85 of 2023, which reformed and simplified the manner in which workers are to be informed about their conditions of employment. After an initial analysis of the provision, the contribution explores some of the application aspects of the provision, with a focus about how to refer to the collective agreement. The analysis concludes with some reflections on the (in)operability of the new provision about the
case in which the employer doesn’t apply any collective agreement and about the case in which the law imperatively requires its application.
