The Belligerent Occupation of Territory

This paper intends to assess to what extent the awards so far entered by the Eritrea-Ethiopia Claims Commission have contributed to the current legal debate on belligerent occupation. In particular, the Claims Commission made an important contribution to the clarification of the scope of application of the law of belligerent occupation when it found that , in situation where title to the territory concerned is disputed, this body of law applies to the military occupation of territory that was peacefully administered by the other Party proior to the outbreak of the armed conflict.
