Abstract:
The purpose of this article is to provide an overview of the role of judicial precedent in Italy, from an historical perspective and in the light of current debate regarding whether and to what extent a progression toward a stare decisis model can be argued. This article does this in three parts: first, in an examination of the civil law system; second in an examination of the criminal law system; and third, in an examination of the administrative and constitutional law system.
