Colloquio su Stato, Diritto e Costituzione. Intervista al Prof. Pierangelo Schiera (Roncosambaccio, 4 giugno 2018)

The interview with Prof. Pierangelo Schiera threads trough a critical reconstruction of the main points of the “constitutional history” of the State-phenomenon, as a quest and an analysis of the constitutive factors of the Verfassung and not only of the ipotetic Konstitution, i.e., of a specific historical declination of social coexistence. Indeed, the interview looks for the connections of the various study methods of the State’s phenomenology and the criterions of legal theory, by poiting out both the influence and the limits of the latter on the conceptualization of the State and of its recent transformations and degenerations. The projectual element of consitutionalism in the globalization age is particularly considered and the outlines of a potential administrative and solidaristic constituionalism, which would strengthen the active role of the citizen, are sketched.
