Colloquio su Storia, Diritto e Costituzione. Intervista al Prof. Paolo Grossi (Citille in Chianti, 10 giugno 2020)

The interview critically investigates the relationship between law and history, with particular regard to the constitutional aspects. In the first part, the method of the legal historian is defined. This method consists in the comparison between juridical experiences, not necessarily connoted in an authoritative or state direction. This characteristic is the base of a non-formal concept of law, understood as an institution and of the pluralistic position compared to the various legal systems coexisting on the same territory. In the second part we retrace the steps that led from medieval juridical plurality to modern legislative monism of the Enlightenment and finally to the postmodern century of the democratic and pluralist Constitutions. Finally, in the third and final part of the interview, we reflect on the methodological tools currently available to the judge and jurist in the interpretation and application of the law.
