La circolazione mortis causa del possesso tra successione ed immissione

Muovendo da un approccio incentrato sulla componente comportamentistica del possesso, si esclude che lo vacua possessio rei possa formare oggetto di atti traslativi. Nondimeno, lo speciale valore economico attribuito al possesso, diverso ed indipendente da quello della res, ha indotto la dottrina ad ipotizzare vicende circolatorie diverse da quelle traslative. Il contributo si propone di verificare se, oltre all’ipotesi (eccezionale) della successio possessionis prevista dal Codificatore in favore dell’erede, vi sia la possibilità di un’attribuzione mortis causa del possesso, attuabile, in maniera mediata, attraverso un legato ad effetti meramente obbligatorî.


Taking the cue from an approach focused on the behavioral aspect of possession, it is excluded that vacua possessio rei can be the object of transfers. Nevertheless, the special economic value attributed to possession, distinct and independent from the one of the res, has led legal scholars to hypothesize circulating events different from those involving transfer. The article aims to examine whether, beyond the (exceptional) case of successio possessionis provided by the law in favor of the heir, there is the possibility of a mortis causa transfer of possession, achievable indirectly through a legacy with merely obligatory effects.
