L’approccio clinico-legale e la questione nel conflitto nell’epoca delle “regressioni” dei diritti

This paper aims to explore the transformative potential of the clinical-legal approach in the context of legal education and the practice of law. Starting from a conception of law rooted in social and cultural dynamics, the article aims to highlight how legal clinics offer a privileged space to critically analyze law “in action”, with particular attention to the experiences of people in vulnerable conditions. It argues that the clinical-legal approach, going beyond a merely descriptive view of the law, promotes a deeper understanding of the role of conflict, of claim, and of agency in the construction of a fairer and more equitable legal system. Finally, the article aims to emphasize the importance of “broadening the gaze” to grasp the complexity of all aspects of the law and to promote a training of those working in the field of law that is at once critical, practical, and oriented towards the protection of fundamental rights.
